One of the worst pitfalls in preparing to open a restaurant is “a finding raised at a government inspection carried out when the fit-out is all but finished.”
If, after the work is done, you’re told “we can’t grant an operating licence like this” or “remove all the wall materials and redo it,” corrective work runs from several hundred thousand to several million yen — and the rent on a space that can’t open yet weighs heavily on you.

For the walls too, the lower section must be finished with something easy to wipe down and clean with detergent, such as a non-combustible decorative panel (kitchen panel). Leaving bare untreated timber or heavily textured material exposed is judged to be “prone to bacterial growth and hard to clean,” and fails.
The fire-inspection barrier: “interior-finish restrictions” and mandatory flame-retardant items
Even more than the health-centre inspection, the one where post-construction rework costs balloon is the fire inspection by the fire department.
What demands particular care are the interior-finish restrictions that apply around a kitchen using open flame.
Around fire-using equipment such as gas ranges and fryers, the Fire Service Act and the Building Standards Act require non-combustible materials — calcium silicate board, non-combustible decorative panels, stainless-steel sheet and the like — for the finish of walls and ceilings.
If, wanting a “stylish café look,” you do self-performed work fixing solid timber or scaffold boards directly to the wall beside or right above the range, it is failed on the spot at the fire inspection, and you’re ordered to demolish and remove it all and start over.
Curtains, noren, carpets and other items used in the seating area are also required by the Fire Service Act to be flame-retardant items that meet the “flame-retardant performance standard” (bearing a flame-retardant label). Bringing in domestic interior products as-is will not pass inspection.
The positions of the fire alarms and emergency exit lights matter too. It frequently happens that after DIY-building new partition walls to divide up the space, an unmonitored zone arises (a blind spot the alarm’s light or smoke can’t reach), and additional fire-alarm work becomes necessary.
How to run the “pre-consultation” that eliminates rework
The one sure way to avoid these legal risks completely is a pre-consultation — held before your site survey, by bringing your drawings to the health centre and fire department with jurisdiction — before you buy any materials or start work.
The concrete steps to make the pre-consultation go smoothly are as follows.
- Prepare a floor plan (layout drawing): a drawing showing the layout of kitchen equipment, the dimensions of the 2-compartment sink, the position of the hand-wash basin, and the position of the swing door separating seating from kitchen.
- Create a finishes schedule and materials list: prepare specification sheets or catalogues for the finish materials used on walls, ceilings and floors (non-combustible decorative panel, calcium silicate board, sheet flooring, water-based paint, etc.).
- Visit the health centre (food sanitation section) in advance: bring your drawings two to three weeks before starting work, and have the sink dimensions, hand-washing spec and floor/wall materials checked.
- Visit the fire department (fire-prevention division) in advance: have the clearances around fire-using equipment, the interior-finish restrictions on walls and ceilings, whether flame-retardant items are required, and any plan to add exit lights or detectors checked.
By recording the name of the officer and what was discussed at the pre-consultation, you prevent any misalignment of understanding after work begins, and can pass the main inspection smoothly.
